About Appellate Division, Third Judicial Department

The Appellate Division, Third Department is one of four intermediate appellate courts in New York State, and it is based in Albany. There are 28 counties in the three judicial districts making up the Third Department, which stretches from the Canadian border in the north to the lower Catskills in the south. The court reviews civil and criminal appeals from trial-level courts, and it can examine both questions of law and questions of fact. Because it sits in the state capital, it also hears many matters involving State agencies.

The Clerk's Office receives briefs, records, and motions, and it provides procedural guidance to parties. The Third Department hands down its decisions on Thursday mornings. Separately, the Office of Attorney Admissions handles admission to the bar for applicants within the Department's jurisdiction and for certain out-of-state and foreign candidates, and it relies on Committees on Character and Fitness to evaluate applicants. Its New York presence is its Albany headquarters in the Robert Abrams Building for Law and Justice at Empire State Plaza.
