About New York State Unemployment Insurance Appeal Board
The New York State Unemployment Insurance Appeal Board is an independent state board that decides disputes over unemployment insurance benefit eligibility and employer contribution liability. It was established in 1938, and its structure and authority are set out in the State Labor Law. The Board has two levels: a hearing level, called the Lower Authority, where administrative law judges conduct hearings, and an appeal level, called the Higher Authority, where Board members review appeals from those judges.
Board members are appointed by the Governor for six-year terms, and no more than three may belong to the same political party. The Board's executive offices are in Menands and Brooklyn, and it lists hearing offices in Brooklyn, Buffalo, Garden City, Hauppauge, Menands, Rochester, Syracuse and White Plains. The Board states that it and its administrative law judges make decisions independently of the Department of Labor.
