About State of New York Supreme Court, Appellate Division Third Judicial Department
Operating from Albany, the Appellate Division, Third Judicial Department, is one of four regional bodies that handle intermediate-level appeals in the state's court system. It reviews questions of law and fact in civil and criminal matters that come from trial courts. Its territory spans 28 counties, and because it sits in the state capital, it also considers appeals from state agencies.
Cases reach the court from the Supreme Court, County Courts, Family Courts, Surrogate's Courts and the Court of Claims. Its Clerk's Office receives briefs, records and motions, and oral arguments are held in person in Albany. The department also has units tied to the legal profession, including an Attorney Grievance Committee.
