About United States Department of Labor, Office of the Solicitor

The Office of the Solicitor is the legal office of the U.S. Department of Labor, an agency within the federal government. It is led by the Solicitor of Labor, a presidential appointee confirmed by the Senate who serves as the Department's legal advisor. The office was established under the Organic Act of 1913 and has roughly 450 staff, including about 350 lawyers, at its Washington, D.C. headquarters and in regional offices. It represents the Department's program agencies in litigation, provides legal opinions and advice, and assists in drafting regulations, guidance and legislation.

The office's services include pre-referral investigative assistance, affirmative and defensive litigation, and legal review of rules. Its work involves enforcing more than 180 federal labor laws. The New York Regional Solicitor's Office, located at 201 Varick Street in New York City, handles most civil trial litigation and legal support for matters arising in New York, New Jersey, Puerto Rico and the U.S. Virgin Islands. Its work arises mainly from the Occupational Safety and Health Administration, the Wage and Hour Division, the Employee Benefits Security Administration and the Office of Federal Contract Compliance Programs. The regional office also assists the U.S. Attorney in certain criminal prosecutions.
